Business Name Jargon and Their Meanings

Business name language used by marketing professionals can often be very confusing due to the mixture of heavy jargons in the subject matter. Some of these are -

• “Legal Name” - This means the official name of a firm doing business. For a sole proprietorship firm the legal name is the full name of the owner. In case of a partnership business which has a written partnership agreement giving a name to the partners, this name becomes the legal name.
Or else the last names of the owners are usually the legal name. For a limited partnership business, LLCs and corporations the legal name signifies the name that is registered with the State secretary.

• “Trade Name “– A trade name refers to the business which may or might not be similar to the legal name of the owners.

• “Fictitious Business Name “- Many times the marketing professionals use the business name different from the legal name of the entity which they own. These can be for an individual firm, LLC, partnership or corporations. A fictitious business name is also known as a DBA name which means “doing business as”.

• “Corporate Name “– A business is required to choose and register a corporate name with the secretary of the state. A limited liability company or a LLC shall register an LLC name and a limited partnership or LP will register as a LP name.

• “Trademark”-Trademark is also referred to as mark. It is a word, design, symbol or phrase which is used by marketing professionals to promote a product or service. A mark used for marketing a service is termed as a service mark.

• “Business Name” – The term business name signifies all terms that is used in a business. This also signifies the name of the business itself, a fictitious business name, a corporate name and also names of the products and services of a business.
